Build a Fire please note that those mentioned in the following article are currently accused and not charged in the claims brought forward.  We are merely submitting facts as they are brought forward as public record or reference.   Behind the Dahisar Railway station situated on Rustom Irani Marg lies the headquarters of a prominent builder in Mumbai, India.  The builder and chairpersons of his company have been brought up on charges such as attempted murder, sexual assault and various other accounts.  This is the story of how money and influence were used as a tool in conjunction with the police to evade justice. On January 25th, 2006, Thempton Irani and various family members moved forward in celebration of an anniversary visiting both his shared children and ex-wife.  The family members consisted of his elder parents, sister, her husband and driver.  At approximately 7:30am, they approached the gates of the estate to be greeted by open arms of the security staff on duty. The original owner of this estate was the developer of IDEAL JAWA (INDIA) LIMITED   Shortly thereafter, Thempton and his family entered the palatial bungalow to occupy the portion bequeathed to him by his late father who subsequently named this portion after him.  Thempton Villa is where his ex-wife and son had currently resided.  The family entered the villa and made themselves comfortable.    The kitchen staff offered food, beverage and laundry service to the family at various intervals during which time the family set out on its preparation for the joyous occasion. At 7:45am, a Percy Chowdhry subsequently followed by Boman Behram Irani who greeted the family one hour later.  They began their solicitation of the family taking into account their every move.  It was at this point in which the ex-wife and her son were relegated to the adjoining room.  Hours passed and the celebrations ensued all under a watchful eye.         Beginning at 1:30pm and in random succession thereafter, various officers employed by the Dahisar Police Station made several trips to the estate.  Engrossed in the celebrations at hand, the family thought nothing of these excursions.  They had no inclination of the events that would unfold later that evening around the corners of the lofty bungalow.   At this point, Shiraz (the ex-wife) was inaugurated as a patsy to both Boman Behram Irani and Percy Chowdrey.  She was forced to deliver idle threats to the family.  Here she was informed to warn the family that all services would terminate leaving them without the need of food or water. As an occupant of the Estate, Shiraz knew more about the character of Boman and Percy.  This was made apparent by her willingness to absolve herself from the celebration held in both her and Themptons honor.  She knew not to question or forsake the authority of these men and diligently fulfilled her assignments under a shroud of guilt that veiled her.   At 7:30pm, Shiraz made what was to be her last stand to be inadvertently interrupted.  Along with his wife Susan, Percy and Boman entered the villa demanding all personal effects of the family.  After retrieving the items, a scuffle ensued prompting Shiraz to vacate the premises in fear.       Dramatization of the event Three gundas then pulled his sister; Shegufa,  to the marble floor as Susan began her own personal vendetta.  She repeatedly thrashed Shegufa’s head against the marble flooring exposing the victims breasts encouraging the dark shadows that overtook the room to have fun with the limp body. Witnessing this account festered rage in Shegufa’s husband.  As he moved forward to protect his wife, Percy swung an iron rod that met Roberts skull prompting him to occupy the floor beneath him.  Robert tried unsuccessfully to maintain focus as he was also dragged down the overpowering staircase and piled onto the lawn where he was met by the bodies of both Thempton and his wife. Thempton’s mother; Treaty, then pleaded with the Accused to stop thes brutal acts.  In response, Percy brutally twisted her middle finger of the left hand and fractured it.   With a swift kick, he brought her to her knees and instructed the gundas to take care of her.   * She now faces permanent damage   One by one, the family members were thrown into an unidentified vehicle that entered the property.  Percy and Boman Behram continued to actively abuse the family members.  Instructing the gundas to beat them rigorously and throw them out of the compound. When Shegufa attempted to vacate the vehicle, one of them raised iron rod to hit her head. Fortunately, the blow missed her person and hit the car door only to bend its framing.  The driver of the accused drove them out of the gate and stopped the car on road leaving the family to their wounds.  Through the rear-view mirror, the family noticed that their driver was being assaulted.  Abhimanyu was rigorously beaten up by 7-8 gundas with rods. The driver has suffered fractures; his limbs are broken and have stitches on his head. After the Accused and their gang had finished their outrageous acts of brutally, the family rushed to a Police Chowky nearby and called the Police to the farm.  The Police refused exclaiming that there were no officers on duty.  After vigorously pleading for their help in the safety of her parents who were still being held at the property, they subsided. Upon arriving to the estate, Shegufah noticed the arrival of a Police Van containing several officers.  She asked to file an F.I.R. while in the presence of Officers which totaled a number of 8-10 officials.  It was then responded by the Three Inspectors on separate occasions that if a complaint was lodged, then they would have to site the Complainant and her ailing family including her aged mother (sustaining a fracture to her left hand), father, husband (maintaining a fracture to the head and gushing blood), and driver (sustaining a fractured leg and skull) for Trespassing and send them to Jail without medical treatment.  The Officers maintained this statement in the following succession:  first by Mr. G.D. Vaishnu, a second who refused to give his name and the third Mr. Kadam.  He also mentioned as a form of intimidation that this was a holiday and no court would hear them for another 7 days and until such time, they would remain in jail.  It was also stated that if any incidences occur from this point such as; further brutality and/or even rape, that they would not take involvement or be responsible. All officers present were friendly (as if having tea) towards the Accused during the incident while abrasive and irresponsive to the Complainant and her family.  Police then advised Shegufa and her family that there was nothing they could do . Photos taken at the inauguration ceremony of the Police Station in which he can be seen awarding several officers involved in the incident     Due to the clout the Accused holds in Dahisar, It was thus manifested that the Dahisar Police would not record the complaint.  The family moved to seek medical attention at  Bhagwati Hospital where, the injuries were recorded and X-rays taken.   Being that the Complainant and her husband are American Citizens, a complaint dated 25th January 2006 was filed before the Consulate General of the United States of America who agrees to do all that is necessary to apply pressure in this matter.     Home Minister R.R. Patil When help was sought from R.R. Patil, he had agreed to take the matter into personal consideration and if necessary, calls for a Panchgama to further investigate the matter.  Four days proceeding this meeting came a threatening call from G.D. Vaishnu; an officer of the Dahisar Branch, at 4:40 p.m.  This is the officer who first arrived on the scene neglecting the families claim, to dissolve his current and future involvement in the matter.  It was a round-a-bout discussion that left Treaty Irani confused as to what message he was trying to convey.  This can be viewed as a retaliatory threat for the family to dissolve their claim to the Minister due to pressure from the Dahisar officers involvement and neglect of his responsibility.   On Tuesday the 13th of February, after attempting to reach Assistant Commissioner Patnaik, his secretary informed Mrs. Treaty Irani that if she definitely feared her safety, she should approach Mr. Patnaik.   On Thursday the 15th of February, the family reached the offices of Mr. Patnaik in which they were again directed to his secretary.  During this meeting, they were informed that a Panchgama had been performed at 4:00 p.m. and that the family failed to show.  They were also informed by the officer that Mr. Boman Rustom Irani and the three officers accused in this matter had cooperated.  Mrs. Irani informed the secretary that the family had not received any notification of such a meeting otherwise they would have shown to participate.  The family has gone through a great deal to seek justice that this is an obvious cover-up invoked by the Police participation.   The secretary continued to argue that we indeed had received a call in the morning or that he had informed Mr. G. D. Vaishnu to place the call.  The family continued with the reply that thy indeed had not received a call.  At this point, the secretary informed the Family that the matter is out of their hands for it is a personal complaint that was filed.  It was then replied that an F.I.R. would have been filed however, the police refused the matter.   It was advised that we wait until the 17th of February for the judges reply to the complaint.  Prior to leaving the office, we approached the secretary as to whether any investigation was being done and if specific information had been pursued relevant to the case In which he replied:  “I don’t know, I don’t know, I don’t know…”           The family is still in hiding with no Police Protection in the matter and wait until Friday the 17th of February at which time the court will pass its first judgment in  the matter.   Meanwhile the family lives in fear for not only their lives but also that of their children who have to constantly shift residence.  While the family seeks refuge, the accused sets out on a defaming campaign against the Complainants family not understanding that this is not an issue of character, but that of a bigger issue.   The big issue that lies here within is the fact of what monetary influence can do in these matters.  A system set-up to protect the average Indian has been modified to pad the pockets of the rich and government officials alike.   If this system cannot protect that of the average Indian, how can it be assumed that it will protect the safety of the Foreign Nationals involved in this matter. Since our report on this incident, both we and other news media involved have been threatened by legal action from the accused.  In the letter, Boman Rustom Irani (the builder) and Percy Chowdrey discard the obvious wounds sustained by the plaintiff.  A majority of the threatening response is spent speaking on the character of Keystone Group / Rustomjee Builders.  Here he speaks of his charitable involvement  in a school created by his company. Rustomjee International School   This is the same school in which Percy and his wife hold prestigious positions.  The parents of these children who attend the school should note that people who resort to undignified behavior are overlooking their children.  If they treat their own family in this nature, one is left to ponder how they would react to another’s. I would also like to remind the public at large that this is not an issue about ones standing within a community.  Character develops from the actions in which he/she pursues.  This incident is only testimony to the real character of Boman Rustom Irani and his cohorts.  After caste and nationality are put aside, can the average Indian seek and find justice?   This story has been reported on by CNN, CNN.IBN, Star and Zee News. We will be reporting on this case as events unfold.   On March 28th...   We were informed by the U.S. Consulate that Boman Rustom Irani attempted to apply for access to the United States but was denied.    The Complainant; Shegufa Haubrich-Irani,  in this case was found to be pregnant at the time of the incident and incurred a miscarriage.   The court as remanded that the police produce charge sheets against the accused in this matter.  They were told not to waste anymore of the courts time by doing so within 14 days. Charge sheets are produced April 17th as the public finds out about the real Boman Rustom Irani.  These charges such as attempted murder have to be proven in court and argued against overwhelming evidence.  Will they be produced and will they be factual... Boman Irani has sent feelers out today to speak of a settlement.  The Complainant in this matter wants nothing of the sort.  She and her family want to prove that justice can be sought after and found in our corrupt country that is India.   On April 17th...   Charge sheets were delayed on account of the fact that the Head Officer; Vaishnu, stated that he did not know how to produce them.  This from an officer that is set to retire in 2 years and during his entire time of service has apparently never produced them so is unaware of the procedure.  This is obviously an incompetent man and transparent delay tactic.  He has hired an instructor to help him and the procedure has been delayed until April, 28, 2006. I am certain that the Report set to be produced will be vague and incorrect for the family has never been questioned by authorities in this matter.  They have not asked for the photos, medical reports of the injuries involved nor testimony of the family involved.   The Complainant Robert Dean Ervin (left) and Shegufa Haubrich-Irani (right)   On May 15th...   Officer Kadam has been asked to retire, charge sheets still have not been produced and an investigation into evidence was suggested by police to the court after the family inquired why they had never performed one. Nearly 4 months after the incident took place is the time when police requested evidence and the opportunity to question the family.  The purpose of the family visiting the station every Wednesday for the period of 90 days for this reason but the police at the Dahisar Station did nothing.  They showed up at the Irani household requesting evidence but the family refused to hand over.   She would essentially be handing surmounting evidence over to police who originally refused to help them and only continue to delay the outcome.  The only verbal interaction they supply is as a messenger to Mr. Boman Rustom Irani.  "Boman is ready to settle, why don't you talk and settle"...  this is all is said on every occasion. Shouldn't evidence be handed over to an independent agency such as the C.I.D. that has been directed to take over the investigation due to the allegations/implications that the police are involved...  Wouldn't it be quite easy for an officer traveling alone to lose evidence on his way to the station... This case goes on a two week hiatus as the judge takes a vacation and Officer Vaishnu learns the basics of filling out a charge sheet.  The police have once again promised to produced those charge sheets during their next appearance.   On May 21st...   Adi K Irani (Thempton’s Father) has been admitted to the hospital in a fight for his life while he and his family await justice in the assault and attempted murder case against Boman Rustom Irani, Percy Chowdhry, Susan Chowdhry and Boman Behram Irani. This is not a unique case in India. Most Indians die while awaiting a trial in India. Boman Rustom Irani is a builder in Mumbai and has incurred a wealth based on lies that has bought a series of delays and pay-offs between himself and Dahisar Police. The court system in India allows this to happen against surmounting evidence. Often times in these cases, it is the assaulted which tend to go punished for reporting such incidents. That is the case here. Boman Rustom Irani and the managing directors of his foundation have been accused of several charges including attempted murder. In the assault that broke out on the orders of Mr. Boman Rustom Irani, an unborn child that did not have a voice or the opportunity to defend themselves was murdered, and now Adi K Irani fights for his life. Another threat (pictured below) I have received since reporting on this incident comes from someone who is reporting to be from outside the family reads:   “…if someone who knows them and is close to them reads this they will give you a good thrashing...” Boman Rustom Irani with Perizaad Zorabian On May 23rd... A member inside the house close to Boman Rustom Irani states that he is not worried about the outcome for he has all the ministers in his pocket. Furthermore, Boman has bumped his wedding by 6 months to get married to Perizaad Zorabian.  is this due of fear that she possibly will not marry a convicted man? On May 25th... A member of The United States Consulate was present while evidence such as the bloody t-shirt, hospital injury reports, photographs, etc., were submitted and recorded at the Dahisar Police Station for the purpose of this investigation. On May 29th... With the help of a Mid-Day News Media reporter, the family met with R.R. Patil once again to make him abreast of the current situation.  The question was asks as to why nothing was being done after he promised personal involvement. Shortly after arriving home, the family received a letter via Speed-Post stating that the accused in this matter have been arrested on all charges, that the investigation is allegedly being handed over to a private agency and will be pursued from there in a higher court. we will present this letter here shortly Because Boman Rustom Irani and those involved were previously granted anticipatory bail, they will remain free as the case proceeds. The Charges brought forward against the accused: 307. Attempt to murder 354. Assault or criminal force to woman with intent to outrage her modesty  326. Voluntarily causing grievous hurt by dangerous weapons or means 330. Voluntarily causing hurt to extort confession, or to compel restoration of property 323. Punishment for voluntarily causing hurt 32[120B. Punishment of criminal conspiracy 109. Punishment of abetment if the act abetted is committed in consequence, and where no express provision is made for its punishment 30[34. Acts done by several persons in furtherance of common intention On October 6th... On October 12th... In an ill fated attempt to take himself out of the situation, Sri Boman Rustom Irani felt a blow by the Bombay Court which re-instates him in the list of charges and forces an independent investigation of the crimes that took place in January.
